When can I challenge a will?

A Will can be challenged only after the Decedent passes away. If you receive a copy of the Petition for Administration by formal notice, then you have twenty days from the date that you receive it to appear in Court and challenge it. If you receive a copy of the Notice of Administration by formal notice, then you have three months from the date that you receive it to appear in Court and challenge it. If you receive neither the Petition for Administration nor the Notice of Administration, then you can challenge the Will at any time prior to the Estate being closed, and if you don’t challenge the Will prior to the Estate being closed, you can also have the possibility of filing a lawsuit for Tortious Interference With an Expectancy of Inheritance against the Tortfeaser after the Estate has been closed.
