Signs of undue influence include someone having a close personal relationship with the testator, being a substantial beneficiary under the persons estate plan, and most importantly being active in procuring the estate planning documents. Active procurement can include selecting the attorney to prepare the estate planning documents, scheduling the appointment for the preparation and the execution of the estate planning documents, attendance at the meeting where the estate planning documents were discussed with the attorney, and even holding on to estate planning documents after their execution.
