If you successfully invalidate a will, you can get the estate to pay for your attorney’s fees. In Florida, any attorney who has rendered a benefit to the estate is entitled to reasonable compensation from the estate. Effectuating the testator’s intent by making sure that the proper will is admitted to probate is considered a benefit to the estate and therefore you can get your attorney’s fees paid for invalidating a will.
