You can appoint the same person as personal representative, trustee and guardian. In Florida only certain people qualify to be a personal representative. That person has to either be a Florida resident or a certain degree of relative of the decedent. The trustee and the guardian can be the same, and sometimes there’s advantages to that. However, if the trustee and the guardian are the same there’s no check and balance system. If the trustee and the guardian are the same the trustee is accounting to him or herself every year and not to the guardian, so there’s very little oversight.
